Я бы вот так сказал. Если употребить существительное, то не надо перевести "решение" ("refusal" = "decision to refuse", в конце концов), а в данном предложении альтернатива и есть, на мой взгляд: "decision by... (XXX) to refuse to institute proceedings against..."
