Swedish term or phrase: Utredning
Hi - I'm looking for a good EN equivalent for utredning as used in civil litigation. The normal investigation, examination, inquiry, etc. don't seem to fully capture the meaning - it almost sounds like evidence. It's used as follows in a district court and court of appeal judgment. Thanks for your help!

UTREDNINGEN I HOVRÄTTEN

Hovrätten har i överklagade delar tagit del av väsentligen samma utredning som tingsrätten.

Om den skadelidande har lagt fram utredning som ger hans påstående en tämligen hög grad av sannolikhet, kan domstolen anse påståendet styrkt för den händelse tillverkaren inte förebringar utredning om tillverkningsförhållandena som förtar sannolikheten hos den skadelidandes påstående.

Utredningen i den här delen av målet utgörs av förhör med parterna .....

Explanation:
As the asker suggests, "utredning" is used so broadly in the quoted text that the concept of "investigation" almost disappears and instead the reference is to the tangible results of the "utredning", which I would call "documentation".

Another option. You have already ruled out all of the other terms I could find in my references. "Study" is the only one that remains. The choice is yours.

Explanation:
Evil ChatGPT has the following. I wouldn't rely unquestioningly on the whole translation or anything, but it's interesting that it seems to offer both translations depending on the context. So maybe it's on the right path:
The word "utredning" in Swedish can be translated into English as "investigation" or "inquiry." In the context you provided, where it seems to relate to legal proceedings, it can also be translated as "evidence" or "case documentation." Therefore, the title "UTREDNINGEN I HOVRÄTTEN" could be translated as "The Investigation in the Court of Appeals" or "The Inquiry in the Court of Appeals."

Here are translations for the other instances you provided:

"Hovrätten har i överklagade delar tagit del av väsentligen samma utredning som tingsrätten."

"The Court of Appeals, in the parts appealed, has reviewed essentially the same evidence as the district court."
"Om den skadelidande har lagt fram utredning som ger hans påstående en tämligen hög grad av sannolikhet, kan domstolen anse påståendet styrkt för den händelse tillverkaren inte förebringar utredning om tillverkningsförhållandena som förtar sannolikheten hos den skadelidandes påstående."

"If the injured party has presented evidence that gives their claim a reasonably high degree of probability, the court may consider the claim substantiated unless the manufacturer provides evidence regarding the manufacturing conditions that undermines the probability of the injured party's claim."
"Utredningen i den här delen av målet utgörs av förhör med parterna ....."

"The investigation in this part of the case consists of interviews with the parties ...."

Explanation:
See my reference and section 16 of the page which says

Is expert evidence permitted in your jurisdiction? If so, how is it dealt with (and in particular, are experts appointed by the court or the parties, and what duties do they owe)?

Expert evidence is permitted. Experts may be appointed by the court (extremely unusual) or a party (very common). Party and court appointed experts typically submit written opinions and give oral testimonies. Party appointed experts are treated as witnesses as regards duties and in terms of compensation.

utredning
case stated

Explanation:
A weasel-word that is traditionally hard to nail with a consistent translation and with a long, scattergun-type list of entries in Gullberg, including findings (of an investigation).

Analysis / vara under utredning: be under *consideration*, Prisma.

My own, non-AI and dictionary-undriven stab:

'CASE STATED IN THE COURT OF APPEAL

The Court of Appeal / (UK: Appellate Court), on the points of appeal, has to all intents and purposes considered (scrutinis/zed) the same case made out as the court of first instance.

If the claimant has made out a case to a fairly high balance (US: preponderance) of probability of his / the latter's averment (assertion), the Court may deem the averment corroborated in the event of the manufacturer failing to *state* a case (make a submission) about the circumstances of manufacture that rebuts (cf. desvirtuar in SPA / detract from or undermine) the claimant's averment'.

Example sentence(s):
  • UK : an appeal by way of case stated is an appeal to a superior court on the basis of a set of facts (case) specified by the inferior court (stated) for the superior court to make a decision on the application of the law to those facts.
  • Just as they do at the initial request level, agencies should be proactive in contacting requesters whenever doing so can facilitate the effective adjudication of an appeal.

neutral  SafeTex: I understand what you mean (make the same case for) but isn't this ambiguous in the sense that the case (legal proceedings) is in appeal so they are looking at the same case !!!

(i) investigation or inquiry, (ii) evidence or body of evidence or report

Explanation:
As Matt Bibby has already pointed out, *evidence* works better in some cases and *inquiry* works better in others. The term occurs five times in the text, and at least one of them is ambiguous due to lack of context:
1. UTREDNINGEN I HOVRÄTTEN: *inquiry* or *investigation*. Note that the object of this higher court's utredning can be the domstolen's ruling in the case as much as the case itself.
2. väsentligen samma utredning: This is the most interesting one IMO: the courts are considering *evidence* or a *body of evidence* or a *report* that is the result of a process of *investigation* or *inquiry*. So there is a metonymic relation between utredning as process and utredning as data.

I'm told that the official English translation of SOU or Statlig utredning is *government official report*, even when referring to an ongoing process.

3. utredning som ger hans påstående and
4. utredning om tillverkningsförhållandena: here, obviously, context suggests that *evidence* is the correct translation.
5. Utredningen i den här delen is a little ambiguous without more sentence context. Is this about a process or about the evidential fruits of that process?
