A new trial will immediately require legal representation for the trial and will risk a loss for the defendant, so it is the less-preferred outcome ofd the two. The phrase is commonly translated as "Proceedings to have a judgement set aside" when used as a header in reports of EU cases. Ansökningen skall ha kommit in till kronofogdemyndigheten inom en månad från dagen för utslaget. 54 § Har återvinning sökts i rätt tid, skall kronofogdemyndigheten överlämna målet för fortsatt handläggning till en tingsrätt som enligt vad handlingarna visar är behörig att handlägga målet.
