"La unión marital de hecho o concubinato fue admitida por primera vez en el ordenamiento legal dominicano por la Constitución de 1963 (que estuvo vigente solo durante siete meses), cuyo artículo 48 §2 dispuso lo siguiente: “La ley determinará en cuáles situaciones las uniones de hecho entre personas con capacidad para contraer matrimonio podrán, por razones de equidad y de interés social, surtir efectos puramente económicos similares a los del matrimonio”. Una disposición análoga (artículo 55, acápite 5) fue aprobada por nuestro legislador constituyente de 2010, con el siguiente texto: “La unión singular y estable entre un hombre y una mujer, libres de impedimento matrimonial, que forman un hogar de hecho, generas derechos y deberes en sus relaciones personales y patrimoniales, de conformidad con la ley".

Il s'agit d'un texte sur la réforme du Code civil de la République dominicaine. J'hésite à traduire par "union de fait" ou par "concubinage". "Concubinage" est le terme utilisé dans le Code civil français mais il est peut-être trop restrictif dans la mesure où en France il existe également le PACS. En même temps, selon la définition ci-dessus il semble que l' "unión marital" se refère au "concubinage". Qu'en pensez-vous ? D'avance merci !
