Portuguese to English translations [PRO]
Law/Patents - Law (general) / Judge's ruling pertaining to a divorce case
Portuguese term or phrase: decisão guerreada
Senão (sic) bastasse essa questão, observa-se, ainda, que a agravante sequer se manifestado nos autos quando foi deferida a tutela de evidência pelo d. Juízo, de modo que a suspensão da decisão guerreada é medida que se impõe.

Forma correta: Se não bastasse...

This is part of an appeal ruling in which the appellate judge ruled in favor of the appellant, annulling the decree of divorce in Brazil. I'm not sure how to translate the phrase in question. I thought of "decision in dispute" and "decision under litigation". Is there a more specific term?

guerrear: 1. Fazer guerra a; COMBATER. 2. Opor-se a, hostilizar. (Aulete)

Please provide at least one reference along with your answer. Thanks!

Asker: Obrigado, mas você não apresentou nenhuma referência que corrobore a sua tradução. "Decision under appeal" é melhor traduzido como "decisão sob agravo". Veja https://www.google.com/search?q=%22decisão+sob+agravo%22

agree  philgoddard: I don't think you need references - this is common sense. You could also say 'the decision being appealed' or 'the appealed decision'. // Clearly not.

assailed decision

Explanation:
Works in the Phillippines and the USA, whilst also rings bells from UK Law Reports.

Example sentence(s):
  • In its Assailed Decision, the Sandiganbayan (Philippino Court) found that the prosecution's evidence was only able to prove that Abalos was brokering the collaboration between AHI and ZTE, but not that he brokered the contract
  • Appellee assails the statute as beyond the power of Congress over interstate commerce, and hence an invasion of a field of action said to be reserved to the states by the Tenth Amendment.

challenged decision

Explanation:
só uma outra opção, mas "decision under appeal" também está correta. Advogados no Brasil gostam de variar os termos, usando sinônimos.

Notes to answerer
Asker: Discordo. "Decision under appeal" equivale a "decisão sob agravo". Veja meu comentário no DB. "Challenged" é "desafiado". De qualquer forma, a pergunta já foi encerrada sem pontuar.
