It would yet again help, in properly structuring my 'pidgin Portenglish' answer, to know if a civil (shipping etc.), 'service = military law) courts martial or criminal context.

There can be a cvil trial for ordinary debt collection as well as a civil jury trial for defamation (libel & slander or malicious falsehood about goods and services) in both the USA and UK.

Otherwise, constituição do processo could be issue of civil rather - than criminal - process.
