Portuguese term

sem prejuizo da sua atualização

Portuguese to English Bus/Financial Insurance contract
Deverá ser estabelecido que o não pagamento da indenização no prazo previsto nos parágrafos 1º e 2º deste artigo, implicará aplicação de juros de mora a partir desta data, **sem prejuízo de sua atualização**, nos termos da legislação específica.

I know that 'sem prejuizo' can mean ' notwithstanding', or 'without prejudice to' etc., but not sure what 'sua atualização' refers to here. 'atualização' is often a tricky one - 'update', 'correction'.... any ideas of how to translate the phrase? Many thanks.

Thanks Jennifer. Yes, customer calls the shots. Can't argue with that..... Have a nice weekend :)
Jennifer Byers (asker) Sep 30, 2011:
Many thanks Due to deadline I had to discuss with the client. She answered as follows: " **without prejudice as to its correction**. In other words the payment of the interest will be based on the original value however if the original value changes, then the new corrected value will apply. There is however some doubt about this as my Brazilian colleagues all say that the Portuguese is not at all clear."
Since this is a SUSEP document, not much we can do about it - just try to interpret its meaning I guess. I think Gilmar was closest - but thanks to all.

Inflation adjustment is the process of adjusting economic indicators and the prices of goods and services from different time periods to the same price level. To adjust for inflation, an indicator is divided by the inflation index. This adjustment process takes prices — generally for a given year (e.g., "1942 dollars") — in the original "nominal dollars" and renders them into "constant dollars" (also referred to as "today's dollars").

1 hr

not excluding the adjustment to inflation

"Sem prejuízo", aqui, quer dizer "sem exclusão de", "não impedindo", "não precluindo" etc.

and applicable adjustments

Some of us were taught not to use "and" in school. Quite a useful word though.
