Nach § 251 InsO muß zwar eine Berechnung vorgenommen werden, ob ein Gläubiger bei Liquidation besser gestellt wird als durch den Plan, es kann sich aber nur um eine Prognoseberechnung handeln, die jedoch vorliegend schon bei nur pauschaler Überprüfung zu dem Schluß kommen muß, daß nur der Plan die Gläubiger eindeutig besser stellt.

.....si tratta comunque solo di un calcolo pronostico, che deve comunque dimostrare già durante il controllo forfettario, che i creditori possono assumere una posizione nettamente migliore, solo attraverso il programma.
