Chodzi o zlecenie opinii, bardzo możliwe że jako biegłego expert witness w sprawie sądowej. Napisałem wstępne ponieważ myślę, że jest to zlecenie, które określa tylko ogólny zarys opinii, a następne pisma określą go szczegółowo. Może to być także zapytanie o warunki zlecenia opinii prawnej - wszystko zależy od tego co w treści - jeżeli wprost mówią, że zlecają to wstępne zlecenie albo nawet bez wstępne, a jeżeli pytają to zapytanie o ofertę w zakresie opinii prawnej

If the instruction of an expert has not been, or cannot be, agreed between the parties, then a draft joint letter of instruction should be prepared in advance of the first appointment (or other hearing of an application to instruct a single joint expert if not the first appointment) for the court’s consideration.

Asking the court to settle the letter of instruction to a single joint expert
6.1
Where possible, the written request for the court to consider the letter of instruction referred to in rule 25.12(2) should be set out in an e-mail to the court and copied by e-mail to the other instructing parties. The request should be sent to the relevant court or (by prior arrangement only) directly to the judge dealing with the proceedings. Where a legal adviser has been appointed as the case manager, the request should also be sent to the appointed legal adviser. The court will settle the letter of instruction, usually without a hearing to avoid delay; and will send (where practicable, by e-mail) the settled letter to the lead solicitor for transmission forthwith to the expert, and copy it to the other instructing parties for information.

Nie wiem, dlaczego Draft. Pismo to tzw. Affidavit of Laws i zawiera pytania do polskiego adwokata o opisanie polskiego prawa i procedur sądowych dot. umieszczenia dziecka w rodzinnej pieczy zastępczej i możliwych scenariuszów, np. co jeżeli rodzice będą chcieli z powrotem starać się o dziecko, czy prawo polskie na to zezwala itp. |
