-unclear what the professional-services context is but, as both or more of us know from UK litigation practice, the first type of fee used to be lawful and the second unlawful and unenforceable if exceeding '100% of the law firm client's base fees'- I will leave open an alternative of 'success of the agency(as in a recent ProZ question) entrusted'

I agree, though, that success fee is the 'overarching' idea.
