English term

As the drafter

English to Spanish Law/Patents Law: Contract(s) Severance agreements
I believe there's an error here, what do you think:

"Any ambiguity in this Agreement shall not be construed against either party as the drafter".

shouldn't it be "or the drafter"?

Neither Party Deemed Drafter. Despite the possibility that one party or its representatives may have prepared the initial draft of this Agreement or any provision thereof or played a greater role in the preparation of subsequent drafts, the parties agree that neither of them shall be deemed the drafter of this Agreement and that, in construing this Agreement, no provision hereof shall be construed in favor of one party on the ground that such provision was drafted by the other.

quien redactó ; en calidad de estipulante

Drafter is used to bypass the drafts-man/-woman conundrum.

> not a typo, but reflects the US American variety of the contra proferentem rule of construction operating against the 'offeror' of the document, namely one of the parties who, acting in that capacity / en su calidad or capacidad / has drafted or employed a professional drafter as an agent to draw up the document or 'engross' the deed. In the UK, the rule is more often than not or 'oftentimes' found in an anti-insurer, small-print context.

I have mooted the alternative 'estipulante' answer, though fre g/hits.
Example sentence:

Contra proferentem is a rule of contract interpretation that states an ambiguous contract term should be construed against the drafter of the contract. The term contra proferentem is derived from a Latin phrase meaning “against the offeror.”

'en caso de duda, el contrato se interpretará en contra de quien redactó' > 'in case of doubt, the contract will be construed against the drafter' / redactar syn: elaborar; confeccionar -> West Mex. etc. SPA/AmE law dictionary
