Spanish term

no superara en mas o en menos

Spanish to English Law/Patents Law: Contract(s)
I am struggling to understand what this means in a contract in Spanish for translation to British English. It is a lease contract.

The context is:

Revision extraordinaria de la renta

...

I think it means the new rent cannot be more than 10 per cent higher or lower than the old rent. Is this correct?

@Jane Mónica was the first in confirming the correctness of your interpretation and translation. If anyone, she deserves the points here and will certainly have my support if she posts an answer.
Best wishes. TC

@ Toni and Monica Would either of you like to put up an answer as you both helped me to arrive at the correct translation.
Luis M. Sosa Nov 30, 2022:
Wtih Tony Source is poorly drafted (even if it does come from a professional lawyer. Seems that "the rent will be increased in exactly 10%" is what they had in mind. Would be nice to know what the source jurisdiction is.
Jane Martin (asker) Nov 30, 2022:
@ Toni I had already spotted this and have queried it with my client but thank you for pointing it out.
Toni Castano Nov 30, 2022:
@Jane Welcome! One more error I overlooked in my previous post:
Dicha renta, *** no variará en más o en menos*** un DIEZ POR CIENTO (10%) de la renta vigente en el último periodo anual anualidad, la renta se revisará.

The highlighted section of the sentence does not make any sense whatsoever. Be careful with it!

I assume they mean the following:
Dicha renta, *** no variará en más o en menos*** un DIEZ POR CIENTO (10%) de la renta vigente en el último periodo anual. Cada anualidad, la renta se revisará.
Jane Martin (asker) Nov 30, 2022:
@ Monica and Toni Thank you so much. The source text is full of errors like this but it does make our job so much harder. Your comments are really helpful. : )
Toni Castano Nov 30, 2022:
@Jane I understand your doubt, which is just the outcome of a wrongly drafted text. The problem is clearly in the choice of the verb "superar" (read, "superará").
The source text reads:
Dicha renta, *** no superará en más o en menos*** un DIEZ POR CIENTO (10%) de la renta vigente en el último periodo anual anualidad, la renta se revisara.
But this is actually equivocal, i.e. wrong and confusing, because if you write “superará” it is obvious that that figure cannot be UNDER 10%, only OVER 10%.

Try this wording instead for your reading of the source:
Dicha renta, *** no variará en más o en menos*** un DIEZ POR CIENTO (10%) de la renta vigente en el último periodo anual anualidad, la renta se revisara.
And yes, I agree with Mónica. Your reading is right. [Just added the missing written accents to the source]

will be neither 10% more nor less than the current market/rental price

As mentioned in the discussion above, the source text is confusing. This is not only because of the obvious word-choice error (no se puede superar utilizando "menos", lo cual requiere otro verbo) but because of the final part of the sentence, "en el último periodo anual anualidad, la renta se revisara", which looks like a run-on.

will be neither more nor less than 10 %

Yes, I think it means that it has to be 10% exactly, no more, no less.

Peer comment(s):

disagree philgoddard : This implies it will be reduced by 90%.
