Foruminvändning

Thank you in advance!

objection based on geographical jursidction

Hello
I think it's this based on my first reference and what "forum" means here. It's geographical rather than "competence" based on the word "torg" in the same reference.
I suppose this objection can be used when the defendant's place of residence is disputed prior to the case being heard.

jurisdictional plea; plea to the jurisdiction

> though a more literal translation of 'objection to the forum' is apt if English is being used as a bridging or 'relay' language into Ukrainian or Russian etc. cf. 'forum-shopping' > the plaintiffs / claimants shop around for a country or US State (e.g. Delaware in the USA for corporate bankruptcy cases) the legal venue that is perceived as the best for bringing their *civil* case or arbitral claim.

Otherwise, plea (misunderstood by some ProZ translators who have tried to educate me: objecting) to the jurisdiction.

Example sentence:

IATE: en plea of lack of jurisdiction CJUE sv invändning om bristande behörighet CJUE

USA: What is a plea to the jurisdiction in Texas law? A plea to the jurisdiction is a dilatory plea that seeks dismissal of a case for lack of subject-matter jurisdiction.
