English term

duty of candour and good faith

English to Czech Other Law (general)
General Duty of Disclosure
As a matter of domestic law the Crown Prosecution Service owes a duty of candour and good faith to the court determining extradition.

This is generally understood to mean that we must act on information that we have received from the relevant judicial authority or state that may assist the defence or undermine the Prosecution case.

In a recent case, the court said that this duty extended to any information held in the requesting state and therefore it was necessary for the CPS to alert you to the obligation and to invite you to consider whether any such material exists that ought to be brought to our attention.
