In the event that any provider of the Warranty Period Guarantee pursuant to this clause 15:
has issued a bank guarantee which has an expiry date that shall occur prior to the Final Acceptance Certificate;
has been downgraded below a rating of A- for S&P and Fitch and A3 for Moody’s (“Downgrade Trigger”); or
is the subject of an Insolvency Event, upon the written request of the Customer and as agreed by the Supplier, the Supplier shall procure that a Bank or insurer (as the case may be) which meets the requirements of this clause 15...
