J'aurais une question un peu urgente.

Comment comprenez-vous "commaging" dans les présentes conditions d'utilisation ?

"Nothing in this clause shall restrict the right of
XXX to bring proceedings against You in any
other court of any competent jurisdiction, nor
shall the ***commaging*** of proceedings in one or
more jurisdictions prevent proceedings from
being initiated by XXX in any other jurisdiction,
whether simultaneously or not, to the extent

introduction de procédures conjointes

Je pense aussi qu'il s'agit d'une déformation provenant probablement d'une reconnaissance de texte automatique, de type OCR.

Selon le contexte, le terme déformé serait alors "co-engaging", ce que confirmerait le texte source qui fait référence à une ou plusieurs procédures devant des juridictions différentes ("proceedings in one or more jurisdictions").

Les documents contractuels prévoient souvent en effet de telles clauses, pour prévenir toute difficulté résultant d'actions conjointes et visant aux mêmes fins, devant plusieurs juridictions. C'est ce qu'on appelle en procédure la "litispendance".

En partant de l'expression classique "to engage of legal proceedings" (introduire une action en justice), il serait donc question ici de "l'introduction de procédures conjointes (co-engage) en justice".

Je ne vois pas d'autres terme pouvant se substituer à ce "commaging", qui est vraiment l'intrus de ce texte...

neutral Daryo : I think you added a twist that is not there in the ST // you turned a plain "one or more ...[legal proceedings]" into them happening "at the same time", which would inevitably imply that there must be at least "two" of them.
