English term

thereunder

English to Spanish Law/Patents Law (general)
[In a medical "Release of Information" form]:

I hereby guarantee payment of any and all charges not covered by this assignment and waive any and all notices and demands in the event of nonpayment thereunder.

I assume, with less than 100% confidence, that "thereunder" reers to "any and all charges not covered by this assignment" and could be replaced by the words "of any such charges".

en virtud de la misma

thereunder refers to the assignment itself, not to the charges. In other words, any failure to pay what is owed under the assignment.

Thereof would refer the charges.

I think

That "thereunder" should actually be "thereof", so use the Spanish equivalent of that, or "of any such charges", as you say.
