Контекст: Qualifications.
Where a party to an agreement governed by French law is vested with a discretion as to the performance of its obligations and that such discretion is not constrained by reference to objective factors or standards (e.g. independent third party, commonly accepted market practice), such obligations may be nullified by the court on the ground that they were assumed subject to a condition purement potestative or for a lack of determination.
