: Pour une fois, je suis d'accord avec vous, Germaine... Personnellement, j'aurais traduit par "effet opposable aux tiers" ou "erga omnes" qui est le synonyme de "in rem". Merci pour vos recherches ;-)

Merci, Laurent. Pour ma part, je pense que "opposable aux tiers" renvoie plutôt au second segment de la phrase (become commercially effective).

: ce n'est pas le sens, mais ça peut être une possibilité, bien qu'il me semble que "have effect in rem" ici = sont exécutoires/s'appliquent in rem

: C'est le contraire : l'effet d'un acte "in rem" le rend effectif et opposable aux tiers, c'est à dire en termes latins "erga omnes" qui est l'équivalent de "in rem".

: L'expression "effet réel" sans autre précision n'a pas de sens en droit français. La traduction est trop imprécise au plan juridique. Même remarque que Germaine ci-dessus.

Certes, le "plain text" est souhaitable, mais quand on pense interprétation, je penche pour "better safe than sorry" (mieux vaut prévenir que guérir). Lors de ma vérification de textes en français, je n'ai pas vu de version de "in rem"; l'expression latine est préservée.
Le pendant des droits réels sont les droits personnels, c'est-à-dire les droits de créance, normalement opposables à une personne donnée.
