Hi,

I need help with this sentence, which appears in a judgement of paternity:

Vad tingsrätten bestämt i underhållsdelen skall såvitt avser tiden efter denna dom lända till omedelbar etterrättelse utan hinder av förd klagan, varför det interimistiska beslutet 25.4.1979 inte skall gälla längre.

Deane again If you have a look at the entries here: https://tinyurl.com/y6j77tkp (from googling "utan hinder av förd klagan") you will see that this is a standard expression in laws and regulations, therefore with reference to "any possible appeal" rather than a specific appeal.

Agneta I get 'förd klagan' to be singular and would need more context to see this referring to other cases.

@Deane Having used up my words in commenting on your answer, I just want to add that "förd klagan" would probably be better translated as "any pending appeal" or similar, rather than "this appeal". As far as I can see, the appeal is being considered, somewhere, but is not the immediate subject of the paternity judgement being translated. In this case I would also put in a word for "notwithstanding" and end your answer "notwithstanding any pending appeal".

First you should recognize that the term is 'efterrättelse' which is misspelled, likely due to some kind of technical artifact. Then you have what I see as overly legalese 'lända till' which the NE explains pretty well.

There, you have about three different terms answered...

Is it me, or do a lot of Swedish judges overdo their legalese? Asks the long time advocate of 'plain language.'

neutral Agneta Pallinder : I disagree with one part: "utan hinder av" should be "notwithstanding" - in other words it is the implementation that is not impeded by the appeal, not the other way round. Many examples if you google "utan hinder av förd klagan".

Point taken... I wasn't looking at that part too closely... and I have a personal grudge against the word notwithstanding. But -- 'by this appeal'... see my change. :-)
