Disadvantages of appealing
Can I be made to start my sentence
again if I appeal?
Yes, if the Court of Appeal decides that you
do not have good grounds of appeal and
have wasted their time. If that happens, the
Court of Appeal has the power to order that
some or all of the time you have served in
custody while waiting for leave to appeal
does not count towards your sentence. This
is known as a ‘loss of time order’.
