Creation is a mortgage in Poland
The mortgage may be established by a way of legal action or a court decision, or a decision of the relevant tax authority - Tax Office, ZUS, KRUS (also in the form of a non-delivered decision). The mortgage is only created at the moment of entry in the land register - this entry is therefore constitutive. The mortgage is disclosed in Section IV of the Land and Mortgage Register.

Establishment of real estate mortgage is one of many ways of securing a debt.
First of all, it should be indicated that a declaration on establishment of a mortgage must be submitted by the owner of a very immovable property in a form of notarial deed. The advantage of such a solution is that the notary must make sure that the prepared by him notarial deed complies with all required legal norms and includes the proper content. Moreover, the notary will assure that the mortgage is entered into a land and mortgage register because an agreement made between a creditor and a immovable property owner is by itself insufficient.
Mortgage shall become effective upon its entry into a land and mortgage register.

Do hipoteki mają zastosowanie ogólne przepisy o ograniczonych prawach rzeczowych, znajdujące się w kodeksie cywilnym, z wyjątkiem art. 251 kc. Jednak przede wszystkim hipoteka uregulowana została w ustawie z 06.07.1982 r. o księgach wieczystych i hipotece. Regulacja hipoteki uległa istotnym zmianom zawartym w ustawie z 26.06.2009 r. o zmianie ustawy o księgach wieczystych i hipotece.

Oświadczenie stems from the Polish law and jargon. We often see it in deeds or other legal documents. I must admit it does sound clunky in Polish too, e.g. oświadczam, że ustanawiam zabezpieczenie w postaci hipoteki or oświadczam, że wyrażam zgodę na.... It would be enough to say 'I/We, the undersigned, hereby create a mortgage (lien)' / (consent...). Instead we have 'I/We declare that I/we create a mortgage' / 'I hereby declare that I consent to...'.
Being literal and true to the original Polish wording, we end up with 'a declaration' because a party to a contract declares sth. I have a few Polish/English dictionaries plus Polish codes in English and I see such phrases there. Are they all wrong? Perhaps.
The key question is: should a legal translation be literal or close to being literal in case of discrepant terminology/legal concepts? Or we should rather go for an idiomatic English/US term at the compromise of literality?
The word "declaration" appears nowhere in the routine practice of real estate law.
The question we are addressing is what to call the document that is produced in connection with "establishment" of a mortgage, thus what to call the oświadczenie. It is not a "declaration" -- plain, pure, and simple. This is just another instance of the Internet being wrong. Szkoda.
