Обратите внимание на пункті 54 и 55. В пункте говорится 54 говорится, что ответчик причинил один убыток истцу. А в пункте 55 - что по вине ответчика возник ещё другой убыток. Каждый из этих видов убытка означает, что он несёт ответственность. А оба они и подавно это означают.
При это пункт 55 начинается фразой " further or alternatively".
По-русски мы сказали бы "в дополнение к этому и независимо от этого".
Имеется в виду, что убыток, описанный в пункте 55, уже сам по себе свидетельствует об ответственности ответчика, а в дополнение к убытку, описанному в пункту 54, - тем более.
Конечно, в таком варианте будет "и" вместо "или" (or), но мне кажется, что смысл именно такой.
То есть нечто имеет те же юридические последствия в дополнение к вышеизложенному и независимо от вышеизложенного.
Может быть, поможет это:
"Do not worry about the phrase ‘further or alternatively’. This is common jargon meaning ‘either or both’. More than one legal claim can be made in a case as long as there is evidence to support each claim".
