Jak widać, chodzi o wielokrotne roszczenie o pomoc publiczną dla tego samego biopaliwa z tytułu jego ekologicznego charakteru, czy też wielokrotne zgłaszanie biopaliwa jako ekologicznego (claimed as sustainable) w celu uzyskania pomocy publicznej.
