I've never seen this phrase before. Does this mean "change" or "cancel" the contract in the following clause, or are they essentially the same thing? This is from the "Warranties" section of a software licensing agreement:
"Gelingt die Mängelbeseitigung an der Hardware nicht oder wird ein Softwareproduktfehler nicht innerhalb angemessener Frist entweder beseitigt oder in einer dem Kunden zumutbaren Weise umgangen, kann der Kunde nach schriftlicher Ansetzung einer den Umständen angemessenen Nachfrist eine Preisreduktion oder, wenn die Tauglichkeit des Produkts zum vertragsgemässen Gebrauch in schwerwiegender Weise beeinträchtigt ist, den Vertrag ganz oder teilweise wandeln."

: cancel, in whole or part, works well, even though some EN lawyers claim a contract cannot be 'cancelled' - as opposed to *avoidance or repudation'* in part vs. in whole of a contract.

"The 3 R-words have acquired different meanings in English contract law. The differences in meaning are quite subtle. A breaching party may repudiate the contract, but termination only occurs if the other party accepts the repudiation. If a party is induced to enter into a contract by a misrepresentation, he may be entitled to rescind the contract.
