English term

observer - hier

English to German Tech/Engineering Patents
The requestor has stated that the patentee has "sought to make an analogy
between the claims of the corresponding US patent and those of the European
patent the subject of this request". The requestor has seemingly made this statement
for reasons of claim interpretation, specifically with regard to the following feature in
claim 1 "a cover (10) which can be arranged above the interior chamber' which is
referred to in the US equivalent as "a removable cover with an underside arranged
over the inner chamber." I do not however accept the argument the
patentee/observer has made use of the US equivalent in the alleged manner. The
observer has indeed argued the claim should be interpreted as the cover being
removable but has not used the US equivalent to back up that argument.

Sagt man in diesem Zusammenhang auch Beobachter, oder ist der Erfinder gemeint? Bin mir total unsicher. Kann jemand helfen?

Although I am sure about the meaning of this term in English in the context, I am not absolutely sure about the German term (hence CL2). "Einwender" is used in the case of third-party observations, which are generally objections, but that doesn't really work in the case of, say, a patent proprietor filing observations to defend his patent.

observer = party that submits/files observations
requester = party that requests an opinion

Your example is from an
OPINION UNDER SECTION 74A
See statement at the bottom
This opinion is not based on the outcome of fully litigated proceedings. Rather, it is based on whatever material the persons requesting the opinion and filing observations have chosen to put before the Office.

Depending on the nature of the request and the party that filed it, the "observer" may be the proprietor of the patent as here
https://www.gov.uk/government/uploads/system/uploads/attachm...
the representative of the patentee/proprietor as here
https://www.gov.uk/government/uploads/system/uploads/attachm...
or the possible infringer as here

FAQ - Third-party observations
I have been trying to file third-party observations using the web form but I get a "please wait" message that remains on the screen and does not allow me to file my comments. What should I do?
