Struggling with the following paragraph so any help with it would be much appreciated!!

"les consequences de la mise en cause de la responsabilité de la Partie envers l'autre n sauraient, en outre, etre supérieures au montant total des rétrocessions de commissions versées au XXX au titre du trimestre civil au cours duquel le fair générateur de la responsabilité de XXX s'est produit."

You really needed to post "mise en cause de la responsabilité" as the header term. Liability is "la responsabilité", the "mise en cause" is the invoking of that liability.

agree Nikki Scott-Despaigne : In context, I prefer your second suggestion. Other suggestions: "holding X out to be liable", "asserting that X is liable", altho' more context (preceding text) might help.

neutral Nikki Scott-Despaigne : This would work if the liability had been determined. The original describes a situation where a claim is being made as X believes Y is liable. He who asserts must prove; "mettre en c. la responsabilité de qlqn" = assertion but not yet proved.
