Chapter 21. Proceedings in the instance of cassation

participating in the case, upon receipt of a copy of the cassation appeal, shall have the right to send a revocation to the court of arbitration in the time frame allowing for its receipt before consideration of the cassation appeal, and documents which prove sending of the copies of the revocation notice to other participants in the case.

2. Revocation shall be signed by the individual participant in the case, or by his/her representative. The revocation notice signed by a representative shall be accompanied by the power of attorney authorizing him/her to handle the case.

Article 168. Return of the cassation appeal

1. The cassation appeal shall be returned:

1.1. If the cassation appeal is not signed or is signed by an individual not having the right to sign it, or by an individual, whose official position is not indicated;

1.2. If the cassation appeal was not forwarded through the court of arbitration which has issued the ruling;

1.3. If the cassation appeal does not include proof of sending of copies of the cassation appeal to the individuals participants in the case;

1.4. If the cassation appeal does not include the documents, verifying payment of the state duty in the determined order and amount, and in cases when federal law provides for deferment of the duty, portion payment of the duty, or decrease of the amount of the state duty, a petition for that is missing or was denied;

1.5. If the cassation appeal was filed after expiration of the determined time frame, and does not contain a petition to re-establish the missed time frame;

1.6. If the cassation appeal does not reference violations or incorrect applications of the norms of the material law or the process law;

1.7. If before a decision concerning filing of the cassation appeal for proceedings is sent to individuals participants in the case, the individual who has appealed the ruling withdraws the appeal.

The cassation appeal shall be returned on the grounds provided for by points 1, 2, 3, 4, 5, 6 of the present section, by the judge of the first instance, on the grounds provided for by point 2 of the present section, by the judge of the instance of cassation appeals, and on the grounds provided for by point 7 of the present section, by the judges of the courts of the first instance and the cassation instance, depending on the instance in which the case was being considered at the moment of receipt of notification of its return.

If the grounds, on which the appeal is returned have been discovered in the instance of the cassation appeal, it shall be returned by the judge of the court of that instance.

2. A decision shall be issued concerning return of a cassation appeal.

3. Decision to return a cassation appeal can be appealed in the cassation instance.
