La teoría de las nulidades constituye uno de los temas de mayor importancia para el mundo procesal, debido a que mediante ella se establece lo relevante en la constitución, desarrollo y formalidad de los actos procesales, ésta última la más trascendente puesto que a través de ella puede garantizarse la efectividad del acto.

De allí, que la nulidad, aunque pueda ser solicitada por las partes y para éstas constituya un medio de impugnación, no está concebida por el legislador dentro del Código Orgánico Procesal Penal como un medio recursivo ordinario, toda vez que va dirigida fundamentalmente a sanear los actos procesales cumplidos en contravención con la ley, durante las distintas fases del proceso 

Finalmente, hay que destacar que en materia de nulidades rige como principio el de la: "trascendencia aflictiva", atinente al perjuicio por la ausencia de las formalidades del acto, y conforme al cual la nulidad por la nulidad misma no es admisible, pues las nulidades no tienen por finalidad satisfacer deseos formales.

We should finally mention that the governing principle in the matter of nullities is the "importance of the grievance", which relates to the harm caused by the lack of formalities in the performance of the act and which does not admit a declaration of nullity on the grounds of nullity itself as nullities are not intended to meet formal wishes.

I am not sure about this but I cannot think of any alternatives. I would really appreciate any possible help! Thanks in advance!

I think the contents of that paragraph are connected with Section 179 (more specifically, its second and third paragraphs) of the Venezuelan Organic Criminal Procedural Code, which provides as follows:

Artículo 179. Cuando no sea posible sanear un acto, ni se trate de casos de convalidación, el Juez o Jueza deberá declarar su nulidad por auto razonado o señalará expresamente la nulidad en la resolución respectiva, de oficio o a petición de parte. El auto que acuerde la nulidad deberá individualizar plenamente el acto viciado u omitido, determinará concreta y específicamente, cuáles son los actos anteriores o contemporáneos a los que la nulidad se extiende por su conexión con el acto anulado, cuáles derechos y garantías del interesado afecta, cómo los afecta, y, siendo posible, ordenará que se ratifiquen, rectifiquen o renueven.

En todo caso, no procederá tal declaratoria por defectos insustanciales en la forma. En consecuencia, sólo podrán anularse las actuaciones fiscales o diligencias judiciales del procedimiento que ocasionaren a los intervinientes un perjuicio reparable únicamente con la declaratoria de nulidad.

Existe perjuicio cuando la inobservancia de las formas procesales atenta contra las posibilidades de actuación de cualquiera de los intervinientes en el procedimiento.

El Juez o Jueza procurará sanear el acto antes de declarar la nulidad de las actuaciones.<i/>

Therefore, as regards “trascendencia aflictiva” I think you could say something like “[...] the governing principle ... is that there must be 'actual harm'” // “that 'actual harm' must have been caused”. As for “nulidad por la nulidad misma”, maybe you could convey the idea saying something along the lines of “nullities do not constitute an end in themselves, as they [...]”.

I forgot to mention that "principio de trascendencia aflictiva" is also simply referred to as "principio de trascendencia". If you look it up that way, you will find a lot more information on the topic. The rule I quoted above is a reflection of the rationale behind that principle of procedural law, which I think is very relevant in the case at hand since the Venezuelan Organic Criminal Procedural Code is mentioned earlier in the text.

In this context I will place two definitions that are legal terms and include the two terms translated:

"...or be accused of committing a crime or misdemeanor that can result in a jail sentence of three years and one day or more..."

"... As a consequence, a decision by the arbitral tribunal that the contract is null and void shall not entail ipso jure the invalidity of the arbitration clause..."

The first sentence is in reference to the term "aflicitva".. which means sentence

The second is in reference to the term "nulidad" which means invalidity
