Causa del contrato es el fin objetivo e inmediato que persiguen las partes al contratar, fin querido y ordenado por el ordenamiento jurídico. La causa del contrato de trabajo es distinta para el empresario y trabajador. Para el empresario la causa es la obtención de los frutos o utilidad de la actividad del trabajador; en tanto que para éste es la obtención de la remuneración correspondiente al servicio que realiza.


La función de cambio trabajo - salario es la causa del contrato de trabajo.
La causa o fin perseguido por las partes debe ser lícito.
Cabe también la expresión de una falsa causa en el contrato, lo que nos lleva a la simulación del contrato.


Si la causa aparente del contrato camufla una real prestación de servicios laborales, cualquiera que sea la denominación que las partes le hayan dado, el contrato será de trabajo con todas sus consecuencias. Si, por el contrario, el contrato aparente es de trabajo y no lo es realmente, el contrato es nulo, por falta de causa.
