Hello,
I am translating into Slovak an English document that has been translated from Portuguese, There is the term "opening the instruction" which doesn't make too much sense within existing context. I found based on reference to provisions of Code of Criminal Procedure that it should be "abertura da instrução":

Artigo 286o

1 – A instrução visa a comprovação judicial da decisão de deduzir acusação ou de arquivar o
inquérito em ordem a submeter ou não a causa a julgamento.

Artigo 287

Requerimento para abertura da instrução 1 – A abertura da instrução pode ser requerida, no prazo de 20 dias a contar da notificação da acusação ou do arquivamento:

What does "abertura da instrução" and "instrução" mean in this context?

Just a sample That ACCUSATION has been deduced in the above mentioned Inquest, under the terms of article no. 283 of the Code of Criminal Procedure, for the facts therein included, and that under the terms of article 287 of the same Law, should you apply for the opening of the INSTRUCTION you must do so within TWENTY DAYS.

The Article no. 287 of the Code of Criminal Procedure talks about instrução, which, definitely, is not instruction in this context.

Hello colleagues, thank you for your help, it is much appreciated. I opt for discovery proceedings, since I need distinguish between police investigation (that is also mentioned in the document) and investigation by a court. Unfortunately, the document was writen in very poor English and it was often hard to understand what its author (a court clerk) actually wanted to say.

disagree Malic Iurie : I think would be more appropriate: pre-trial hearing (because it is before a judge) or investigation by the pre-trial chamber (and not by common judge). My comment is just for the future reference (I was looking for a term and found this post).

opening of the investigation

This is an example of several sentences I've found: "The Public Prosecutor's office ordered the opening of an investigation by the national brigade of the criminal investigation department."

opening of a formal investigation

A fase de instrução propriamente dita traduz-se frequentemente por pre-trial stage. Já o conceito de abertura de instrução, por iniciar o mais abrangente processo investigatório, tem uma tradução ligeiramente diferente para "opening of a formal investigation". Desta forma, traduziria de forma diferente os dois conceitos referidos.
