Jest - niefortunnym, by nie powiedzieć nonsensownym - zawłaszczeniem pojęcia od - "badania czystości patentowej"; po prostu nie ma - badania czystości rejestrowej, a wszyscy posługujący się tym zwrotem żyją :) w samozadowolonej nieświadomości, bo błędnie tego używają w odniesieniu do znaków towarowych; po prostu - błędnie posługują się kalką od "czystości patentowej";
ustawodawca polski posługuje się terminem "badanie zdolności ochronnej", bo znaki towarowe są wskutek noweli ustawy - przedmiotami, na które udziela się praw ochronnych, a badanie zdolności rejestrowej jest oceną cech odróżniających;
ustawodawca amerykański posługuje się terminem - "trademark clearance", co na gruncie polskim jest bezużyteczne, bo mamy system badawczy znaków przed udzieleniem prawa ochronnego, a nie - jak np. w USA - system rejestrowy.
Dlatego - jeśli autor upiera się przy sformułowaniu -- "Spółka zajmuje się badaniem zdolności i czystości rejestrowej znaków..." powinien konsekwentnie zgodzić się na użycie - "trademark clearance", co jest prawdą, ale też nonsensem na gruncie polskim.
