The bulleted point says simply:
La doctrine de commenter que … [followed by a quote from case law)

disagree Daryo : the ST has nothing to do with the construction in the ref. quoted//So far looks more like : "the doctrine consisting in commenting (?)" -- yes, sounds strange, so I think you need far more of the ST to make your mind, at least the end this sentence.
