الاصل براءة الذمة وانشغالها عارض يقع الاثبات على عاتق من يدعي ما يخالف الثابت اصلا مدعيا كان ام مدعى عليه

This sentence has appeared in a court judgment [Court of Cassation's judgment],

In principle, the person’s financial liability is absolved, however any allegation to contrary to this principle shall be incidental. Accordingly, any person who alleges contrary to what has been proved in principle or incidentally, whether such person is a plaintiff or a defendant, shall be required to either establish the presence of such debt or the acquittal of the same as the case may be.

هذا صحيح ،لكن هل هنا يعود حرف الهاء في كلمة شغلها على براءة الذمة ؟ فتصبح شغل براءة الذمة عارض ؟

اعتقد والله أعلم أن الالتباس لديك جاء بسببب كلمة وانشغالها أرى أن كتابتها هكذا "وإن شغلها عارض" وهي إن الشرطية، ودليلي على ذلك جواب الشرط يقع الأثبات على عاتق ما... ف

You could go for "innocent until proven guilty" as a technical equivalent to avoid literal rendition but please double check with your client.
