From a procurement contract:

"unless an application is filed with a Court for the submission of the Contractor to a winding up or insolvency procedure, under Royal Decree No. 267 of 16 March 1942 or any other winding up procedure provided by applicable Law, unless such application is being contested in good faith and with due diligence and is *discharged or struck out* within 60 (sixty) days;"
