Spanish term

se tenga presente la cesión formulada y por constituido....

Spanish to English Law/Patents Law (general) A ITER admitida en el cur
This is one of those notarial "sign offs" on a document which registers the transfer of rights between one company and another. The full sentence is "Por lo manifestado solicitamos se tenga presente la cesión formulada y por constituido el domicilio procesal de la cesionaría".

It seems to be saying something like "through the contents of this document we request that the transfer is made and is recorded at the address of the assignee."

But is this right? And has anyone see this before?

Many thanks. Sian.

@Helena Rights are usually "assigned" but the answer is somewhat optional.

@AllegroTrans I think the "transfer of rights" is the "cesión". Although it's quite possible you've seen something that I haven't.

the assignment is hereby formally recorded...

Sian, whilst you have the basis of what this means, this is a legal doc and the translation needs to be in rather more formal legal English.
Personally, I would suggest something like:
This assignment(transfer) abd the address for service of the assignee is hereby formally recorded

neutral Andrea Viaggio : I think that "formulada y constituída" is not only "recorded" it is more than that. I shouls say "formally // dully created" "formed"

not dully! but please see my comment re your own suggestion
agree Helena Chavarria : Maybe it would be a good idea to include the word "transfer", as "assignment" has many definitions.

would it not depend entirely on the context? (which we have not got)

And for "constituida en el domicilio procesal de la cesionaria" = and "served at the address of the assignee"
Peer comment(s):

neutral Helena Chavarria : I think you meant to say "duly". In English, "dully" means something quite different!

Yes, "duly". Thank you!!
neutral AllegroTrans : definitely not "dully"; and I think you "execute" an assignment rather than "create" one
