. The permanent "bailout" mechanism for Member States in financial difficulty must clearly detail how the private sector would be brought in to help, how non-Eurozone countries would be involved, and how the EU budget would be affected, says a resolution adopted by Parliament on Thursday.
The need for a unified European bond market, the introduction of Eurobonds and the creation of a European stability agency to handle debt crises are also discussed.
MEPs warn against deciding the bailout mechanism details in back-room, late-night deals among Member States.
Clarity is of the essence
Parliament calls for great attention to be given to clarity on a number of issues, arguing that otherwise it will be difficult to ensure stability.
It also argues that private sector participation in any burden-sharing should be handled on a case-by-case basis, and calls on the Commission to present a comprehensive description of how investors, savers and market participants will be involved and to state explicitly that the mechanism will be fully consistent with IMF policy regarding private sector involvement.
The Commission is asked to clearly indicate and prioritise which EU spending would need to be sacrificed if almost half the EU budget were to be requisitioned, as would be possible under the current (temporary) bailout mechanism rules.

The European Council is expected to adopt the general framework for the bailout mechanism on Friday with the details regarding its functioning set to be worked out in 2011.

MEPs call for the creation of a European stability agency to ensure a unified and highly liquid European bond market and ask the Commission to look into and come forward with proposals on what other instruments could be devised to ensure appropriate access to finance for Member States.
Other than the need for the private sector to take some of the burden, the resolution stresses that the conditionality for obtaining assistance from the mechanism should aim to restore sustainable growth, rather than restore stability at the expense of the most vulnerable, by lowering minimum income and aggravating poverty and inequalities.

Birmingham Magistrates’ Court
Date of Hearing: 19 May 2009
I write further to your attendance at the above court today where you were represented by me.
Prior to the hearing, I reiterated the advice given to you by my colleague X at your last court appearance about the strength of the case against you. After giving the matter further consideration, you decided that you would accept that you did have the items in your possession in order to steal money from telephone kiosks.
I advised you that you would receive some credit for this guilty plea even at this stage and that the credit would be given to you by up to 25% reduction in your sentence. I was hopeful that you would be given a community order but advised you that you were still at risk of a custodial sentence as, by admitting the offence, you would be accepting that you had breached the two conditional discharges which had been imposed upon you in March 2009 for similar offences and so you would also be sentenced for those matters.
At the hearing, you entered a guilty plea to the current offence and admitted breaching the conditional discharges. I explained your circumstances to the Judge and he was of the view that he would have imposed a community order upon you but could not do so as the Probation Service are unwilling to work with a person in your situation i.e. of no fixed address and not able to speak any English.
The Judge’s sentencing options were limited therefore to imposing an immediate custodial sentence. He agreed with me that this should be a short sentence and imposed the following:
1. for the current offence, 28 days’ imprisonment;
2. for the breach of the 2 conditional discharges, 14 days’ imprisonment on each, consecutive to the above sentence but concurrent to each other.
This is a total sentence of 42 days’ imprisonment of which you will serve up to half in custody. You have already served 7 days and the Judge ordered that to count towards your sentence. You will therefore be released within the next 14 days.
The remainder of your sentence (i.e. the last 21 days) is spent on what is known as “on licence”. This is spent outside prison. However, if you breach any of your licence conditions (of which you will be informed when you are released) you can be recalled to prison to serve the rest of your sentence. Being arrested and charged, even if you are not subsequently convicted, with any offence whilst on licence is usually regarded as a breach of your licence and can lead you to being recalled. It is therefore particularly important that you do not commit any offences during your licence period.
You have the right to appeal against the sentence. If you wish to do so you must submit a notice of appeal within twenty one days of the date of your sentence. An appeal would involve your case being re-opened in front of a Judge at the Crown Court. The Judge could increase as well as reduce your sentence. If your appeal fails the Judge could also order you to pay costs which would run into hundreds of pounds. It is my view that the Judge would not reduce your sentence. I therefore advise you not to bring an appeal in this case. Please contact me as a matter of urgency if you wish to discuss this issue further.
I will now close your file which will be held in our archives for a period of three years before being destroyed. If you wish to obtain any information from your file please contact this office quoting the reference number at the top of this letter.

Kontaktujem Vás na základe Vašej dnešnej účasti na vyššie uvedenom súde, kde som Vás zastupoval.
Pred pojednávaním som Vám zopakoval radu o závažnosti konania proti Vám, ktorú Vám poskytol môj kolega X počas Vašej poslednej účasti na súde. Po Vašom ďalšom zvažovaní, ste sa rozhodli, že súhlasíte s tým, že ste mali isté nástroje v osobnej držbe na odcudzenie peňazí z telefónnych búdok.
Poradil som Vám, že by porota mohla dokonca aj v tomto štádiu prihliadať na toto priznanie viny pre súdom. Výmenou by bolo zníženie trestu do 25%. Dúfal som, že dostanete príkaz na verejnoprospešnú činnosť, ale upozornil som Vás, že Vám stále hrozí odsúdenie na trest odňatia slobody, pretože priznaním sa k trestnému činu, by ste súhlasili s tým, že ste porušili podmienky dvoch podmienečných prepustení, ktoré Vám boli uložené v marci 2009 za podobné prečiny a že môžete byť za nich aj odsúdený.
Na pojednávaní ste predložili priznanie svojej viny za súčasný trestný čin a priznali porušenie podmienok podmienečných prepustení. Ja osobne som vysvetlil Vaše okolnosti sudcovi, ktorý Vám chcel udeliť príkaz na verejnoprospešnú činnosť, ale nemohol tak urobiť, pretože sociálny kurátor nebol ochotný spolupracovať s osobou vo Vašej situácii, t.j. osobou bez trvalej adresy a osobou, ktorá nehovorí po anglicky.
Preto boli možnosti sudcu pri rozhodovaní o Vašom odsúdení veľmi limitované a na základe toho Vám uložil trest odňatia slobody. Dohodli sme sa, že odňatie slobody bude v krátkom trvaní a uložené za týchto podmienok:
1. za súčasný trestný čin, odňatie slobody na dobu 28 dní
2. za porušenie podmienok dvoch podmienečných prepustení, odňatie slobody na dobu 14 dní za každé porušenie, ktoré bude nasledovať za vyššie uvedeným trestom a s ktorým bude v tom istom čase aj súbežné.
Spolu to činí 42 dní trestu odňatia slobody, z ktorého polovicu si odpykáte vo väzbe. Doposiaľ ste si odsedeli 7 dní a sudca nariadil, aby boli započítané do Vášho trestu. Z tohto dôvodu budete prepustený v priebehu nasledujúcich 14 dní.
Zvyšok Vášho trestu (t.j. ďalších 21 dní) budete tráviť v tzv. podmienke, a to mimo väzenia. Avšak, ak porušíte niektorý z bodov tejto podmienky (o ktorých budete poučený pri prepustení), budete povolaný späť do väzenia, aby ste si odpykali zvyšok Vášho trestu. Zatknutie a obvinenie za hociaký prečin počas trvania podmienky, dokonca aj bez následného odsúdenia, sa zvyčajne považuje za porušenie Vašej podmienky a môže viesť k Vášmu opätovnému uväzneniu. Je preto obzvlášť dôležité, aby ste nespáchali žiadny trestný čin počas doby trvania podmienky.
Máte právo odvolať sa proti tomuto rozsudku. Ak tak chcete urobiť, musíte podať odvolanie do 21 dní od dátumu rozsudku. Odvolanie by zahŕňalo znovuotvorenie Vášho prípadu v prítomnosti sudcu vyššieho súdu Crown Court. Sudca môže zvýšiť, ale aj znížiť Váš trest. Ak by Vaše odvolanie nebolo úspešné, sudca Vám môže nariadiť, aby ste zaplatili súdne trovy, ktoré sa môžu pohybovať aj v rozmedzí stoviek libier. Podľa môjho názoru, Vám sudca trest nezníži. Preto Vám radím, aby ste nepodávali odvolanie v tomto prípade. Prosím kontaktujte ma ak budete v núdzi a budete chcieť prebrať túto záležitosť ďalej.
