De 30% regeling
Werknemers die naar Nederland komen kunnen onder bepaalde voorwaarden een belastingvrije vergoeding voor de extraterritoriale kosten krijgen van 30% van het loon inclusief de vergoeding. Deze zogenoemde 30%-regeling wordt vanaf 1 januari 2012 op de volgende punten aangescherpt:
• schaarse specifieke deskundigheid
• periode dat van de 30% regeling gebruik gemaakt kan worden
• definitie van het begrip ‘ingekomen werknemer’
• promovendi
Als een werknemer niet (meer) onder de 30%-regeling valt, dan kunnen wel de werkelijke extraterritoriale kosten vrij worden vergoed.
Schaarse specifieke deskundigheid
Om gebruik te kunnen maken van de 30%-regeling moet de werknemer die naar Nederland komt, beschikken over specifieke deskundigheid die op de Nederlandse arbeidsmarkt schaars aanwezig is. Per 1 januari 2012 wordt dit ingevuld met een salarisnorm: er is sprake van een schaarse specifieke deskundigheid als de werknemer een fiscaal loon heeft van € 35.000 (exclusief de vergoeding) of meer. Voor wetenschappers geldt geen salarisnorm. Voor werknemers met een afgeronde masteropleiding die 29 jaar of jonger zijn geldt een verlaagd inkomenscriterium van € 26.605. In de meeste gevallen zal niet specifiek meer op schaarste worden getoetst. Dit gebeurt alleen nog wanneer (bijna) een gehele beroepsgroep boven de salarisnorm uitkomt.
Periode dat er gebruik gemaakt kan worden van de 30% regeling
Nu kan er maximaal 10 jaar gebruik gemaakt worden van de 30%-regeling. Deze periode wordt met ingang van 1 januari 2012 ingekort naar 8 jaar. Deze aanpassing geldt niet voor werknemers die voor 1 januari 2012 al gebruik maakten van de 30%-regeling. De looptijd van maximaal 8 jaar geldt dus alleen voor nieuwe gevallen.
Definitie ‘ingekomen werknemer’
De 30%-regeling voor werknemers die naar Nederland komen geldt vanaf 1 januari 2012 alleen voor werknemers die minstens 150 kilometer van de Nederlandse grens woonden voordat zij in Nederland gingen werken.
Promovendi
Buitenlanders die na hun promotie aan een Nederlandse universiteit in Nederland gaan werken, konden geen gebruik maken van de 30%-regeling doordat de periode van promoveren werd gezien als periode van verblijf in Nederland, waardoor geen sprake was van een vanuit het buitenland ingekomen werknemer. Per 1 januari 2012 wordt de periode van promoveren voor de 30%-regeling niet gezien als periode van verblijf in Nederland, zodat deze groep wel in aanmerking kan komen voor de 30%-regeling bij de eerste baan na promoveren.
Overgangsrecht
Voor ingekomen werknemers die vóór 1 januari 2012 onder de 30%-regeling vallen, geldt overgangsrecht. Er zijn 2 situaties mogelijk:
• De werknemer heeft op 1 januari 2012 nog geen 5 jaar gebruik gemaakt van de 30%-regeling. Na afloop van het 5e jaar dat deze werknemer gebruik maakt van de 30%-regeling wordt getoetst of deze werknemer voldoet aan het nieuwe inkomenscriterium en aan de aangescherpte definitie van ingekomen werknemer (150 kilometercriterium). Voldoet de werknemer niet, dan valt deze werknemer vanaf dat moment niet meer onder de 30% regeling.
• De werknemer heeft op 1 januari 2012 al 5 jaar gebruik gemaakt van de 30%-regeling. In dit geval wordt niet opnieuw getoetst aan de nieuwe criteria en blijft de looptijd van de 30%-regeling maximaal 10 jaar.

The 30% scheme
Subject to certain conditions, employees who move to the Netherlands are eligible for a tax-free allowance for extraterritorial expenses equal to 30% of their salary including the compensation. As of 1 January 2012, this so-called 30% scheme will be modified on the following points:
• scarcity of specific expertise
• period over which the 30% scheme can be applied
• definition of "employee moving to the Netherlands"
• PhD candidates
If an employee is not eligible, or is no longer eligible, for the 30% scheme, the employee is still eligible for a tax-free allowance equal to the extraterritorial expenses actually incurred.
Scarcity of specific expertise
To be eligible for the 30% scheme, an employee who moves to the Netherlands must have specific expertise that is in short supply in the Dutch labour market. As of 1 January 2012, the criterion for scarcity will be the salary level: If an employee has a taxable salary, excluding the 30% allowance, of €35,000 or more, the employee will be considered to possess specific expertise that is in short supply. However, this minimum salary criterion will not apply to scientists. A lower minimum salary criterion of €26,605 will apply to employees who have completed the requirements for a master’s degree and are 29 years of age or younger. In most cases, the scarcity criterion itself will no longer be applied. It will still be applied only if all or most of the members of a professional group have salaries exceeding the minimum salary criterion.
Period over which the 30% scheme can be applied
The maximum period over which the 30% scheme can be applied is presently 10 years. As of 1 January 2012, this period will be reduced to 8 years. However, this reduction will not apply to employees who were already making use of the 30% scheme before 1 January 2012. In other words, the new maximum period of 8 years will apply only to new cases.
Definition of "employee moving to the Netherlands"
As of 1 January 2012, the 30% scheme for employees who move to the Netherlands will apply only to employees whose place of residence was located at least 150 km from the Dutch border before they started working in the Netherlands.
PhD candidates
Under the old scheme, foreigners who first completed their PhD degree at a Dutch university and then started working in the Netherlands were not eligible for the 30% scheme, as they were considered to be living in the Netherlands during their period of study for a PhD degree and therefore did not satisfy the condition of "an employee moving to the Netherlands." As of 1 January 2012, for the purpose of the 30% scheme, the period of study for a PhD degree will no longer be considered a period of residence in the Netherlands, and this group will therefore be eligible for the 30% scheme for their first job after completing their degree requirements.
Transitional provisions
Transitional provisions apply to employees who moved to the Netherlands and were eligible for the 30% scheme prior to 1 January 2012. Two situations are possible in such cases:
• As of 1 January 2012, the employee has made use of the 30% scheme for less than 5 years. After the end of the fifth year that the employee has made use of the 30% scheme, an assessment will be made as to whether the employee complies with the new salary criterion and the new definition of an employee moving to the Netherlands, i.e. the 150 km criterion. If the employee does not meet these criteria, the employee will then no longer be eligible for the 30% scheme.
• As of 1 January 2012, the employee has already made use of the 30% scheme for five years. In that case, the new criteria will not apply and the maximum period during which the employee can make use of the 30% scheme remains 10 years.
