Je bute sur ce passage, et plus précisément sur la traduction du mot "licensed".

If the Film is licensed or distributed in a package with other titles restored through the Laboratory, The Foundation makes a reasonable allocation among the motion pictures licensed or distributed together and will then apply the percentage set out above.

Comment traduiriez-vous ce terme dans ce contexte ?

agree  Eliza Hall: As Ph-b says, there needs to be a verb because the film isn't "sous licence" yet. In the future it might be licensed (mis sous licence) or, to put it another way (identical meaning), might be the object of a license.

I think the passive voice is what's confusing people. This is the process, as I understand it from the text and from film licensing -- I'm putting this in the active voice so it's clear who's doing what:

1. The Laboratory restores old films.

2. The Foundation controls a portfolio of films, and grants distribution/broadcast licenses for films under its control. That is, a TV network, cinematic distributor or internet broadcaster pays the Foundation licensing fees for the right to show a certain film or films.

3. Therefore, the contract says that if the Foundation grants a license to any film that was restored by the Laboratory, the Laboratory gets a cut of the licensing fees. (The obvious reason for this is that the film would not have been in good enough condition to broadcast if the Laboratory hadn't restored it -- these licensing payments are how the Laboratory gets paid for its work.)

Daryo a raison ; j'étais tellement obnubilé par la traduction de licensed que j'ai perdu de vue l'ensemble de la phrase. Pas top...

Il faudrait donc traduire par qchose comme : « Si les droits sur le Film sont cédés ou si le Film est distribué... »

Je reprends donc le début de ma réponse précédente et je garde l'idée du film faisant l'objet d'une licence, ce qui n'est pas en contradiction avec le commentaire de Daryo. Seule réserve : je n'ai trouvé que deux occurrences fiables et pertinentes - et hors de France s'il s'agit du pays de destination de votre traduction. Donc :

« Si le Film a fait l'objet d'une licence ou est distribué... »

Sinon, une autre possibilité, mais qui ne mentionne pas la licence de manière explicite :

« Si les droits sur le Film ont été cédés ou si celui-ci est distribué... »

neutral  Daryo: the ST is written from the viewpoint of those giving a licence to use/exploit films they have restored, so from their viewpoint it's in fact the exact opposite of "droits acquis" // "bought" works only from the viewpoint of the buyer!//that works.

disagree  Eliza Hall: It's not the film, but the droit that is cédé. And the droits in a film aren't normally cédés in this way (as software is, in your example), piece by piece or in terms of the number of users.

neutral  Eliza Hall: Films are diffusés if you're talking about their being shown in theaters, broadcast on TV, etc. But this text is talking about *the granting of rights* to show/broadcast/stream/etc. films. It's a different action, thus a different word/term, than diffuser
