1 “BATNA” se odnosi na alternativu stranaka ako pregovori propadnu – druge raspoložive opcije. Ona je često ključ za razumijevanje ustupaka koje čini svaka strana. Određivanje BATNI uključuje pažljivo istraživanje moći svake strane vlasti i alternativa koje se temelje na pravima radi postizanja sporazuma. BATNE su polazna točka za sve pregovore. Realistično razumijevanje vlastitih BATNI ili BATNI drugih strana je od vitalnog značaja za određivanje pregovaračke moći u bilo kojem pregovoru.
