onderhandse akte

instrument:= in commercial law, a written document that records an act or agreement and that is regarded as the formal expression thereof, and that therefore provides the evidence of that act or agreement

You haven't given any context, but we've had both words many times before. I agree with your dictionary: private instrument, deed, or agreement.

private deed

document signed by a person in his/her private capacity

I would go for sure and use "document signed by a person in his/her private capacity", since een onderhandse akte refers to some sort of private agreement. If you would rather avoid the use of the word "agreement" you can also use "private deed".

Good luck.

I'd personally opt for "private instrument' or - more fully - "privately executed instrument" as opposed to "public instrument" (NL authentieke akte).
