If this is a description of the injured individual, then the ins. co. -supposed to pay the claim - takes over the latter's rights and remedies by 'standing in his or her shoes' as a first-line subrogee, then seeks recovery or recoupment from the Accidents-at-Work body, the 'statutory subrogee'.

The party resuming proceedings
In the cases referred to in Article 329, first paragraph, the proceedings are resumed from the position they were in at the moment of suspension:
